SHORT TERM RENTAL AGREEMENT for Featherbed Island House

THE PARTIES HERETO, IN CONSIDERATION OF THESE PRESENTS, AGREE:


PAYMENTS: Guest is responsible for full payment for the rental period. A deposit of 50% (base rent, 9% Maine State Lodging Tax and Pet Fee if applicable) plus $45 damage insurance fee is due immediately along with this signed agreement to hold the requested rental dates and to consider the rental confirmed. The balance is due thirty days before check-in.

 


CANCELLATION POLICY: Failure to make payments when due will result in cancellation of this Agreement. Upon cancellation by the Guest or Homeowner for any reason with more than sixty days before check-in date, your deposit will be promptly refunded in full.    At the 60th day prior to check-in, the total reservation deposit is NONREFUNDABLE. Cancellation with less than 30 days notice - no refunds. If you think you may need to cancel this reservation due to a covered reason in the standard Travel Insurance Policy you are strongly encouraged to purchase such a policy from the insurance agency of your choice.    We highly recommend you purchase travel insurance. If you think you might have to cancel this reservation for a non-covered reason you are encouraged to purchase the Cancel for Any Reason Travel Insurance Policy. No refunds will be made after arrival.

 


INSPECTION OF PROPERTY: If Guest does not personally inspect the premises prior to signing this Agreement, Guest agrees to accept the rental property, as is, upon arrival. In addition, Guest agrees that Guest will not be entitled to a refund of rental money and will have no claim or recourse against the owners of the property.

 


SECURITY DEPOSIT: There is no security deposit required under this agreement. In lieu of security deposit, a damage insurance will be acquired by the homeowner in the amount of $3000. The premium for this is $39 and will be paid at time of deposit. ARDI is an insurance plan that provides coverage for accidental damages to vacation rental properties, in place of a security deposit. However, if damages EXCEED the $3000 of insurance, guest is responsible for anything over and above what ARDI compensates for and/or for excessive cleaning which is not covered by ARDI.
 


ENTRY OF PREMISES: Homeowner or Homeowner’s agent may enter the premises immediately, in the event of an emergency, in order to perform necessary repairs or maintenance, and within 24 hours of notice for normal maintenance or to show a prospective renter or buyer the property. Equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Agent will correct the problems as soon as humanly possible. An authorized employee or repairman may enter the premises to repair such equipment. Refunds will not be issued due to malfunctioning equipment including Internet access.

 


OCCUPANCY: The total occupancy of Featherbed Island House cannot exceed six (6) persons.

 


DAMAGES: The Guest will be responsible for all damage or breakage and/or loss to the premises, except normal wear and tear which may result from occupancy. The Homeowner or Homeowner 's representative will define normal wear and tear. The entire building and all grounds will be left in the same good and habitable condition in which it was found upon arrival. Any damages or unusual conditions found upon arrival will be reported to the owner or property manager within one (1) hour of occupancy or, if arrival after 6:00 p.m., before 9:00 a.m. the following morning. Otherwise, repair costs for any pre-existing damages may be posted against the Guest’s security deposit for such repairs.

 


LINENS AND TOWELS: Sheets, towels, pillows and blankets are provided are NOT to be taken outside or off the premises.

 


PERSONAL PROPERTY: Guest understands that any personal property of and used by Guest is not insured by Owner and Owner shall not be responsible for any lost, stolen or missing property of the Guest or property of Guest left after check out.

 


PET CLAUSE: No pets are allowed under this lease agreement unless arrangements have been made with owner, pet fee has been paid and pet wavier has been signed.

 


OFF-LIMIT AREAS: The entire garage/barn is to remain off limits to guests at all times unless express permission is given by owner (ie. to dispose of full garbage/ recycling bags). In absolutely no circumstances should any guest ascend the staircase to the second floor of the garage/barn.
 


SMOKING POLICY - NO SMOKING! The property has been smoke free and the Homeowner’s requests that it remains as such. Smoking is prohibited inside the house and any evidence of smoking inside the house, the renter shall be charged for the cleaning of the entire property in order to restore it back to its original smoke free condition. ARDI damage insurance will not cover any smoke odor removal! Any smoking outside must be done so the smoke does not enter the house and cigarette butts are to be disposed of properly.

 


SEPTIC: The cottage is on a well and septic system.    The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products or products other that toilet tissue have been flushed and clog the septic system, you could be charged for damages the could exceed the amount of travel insurance claim.

 


GRILL AND FIREPIT: Use of the grill and/or firepit will be only away from the house, as to not cause damage to the property. The grill and utensils will be cleaned before departure and left in useable condition.

 


TRASH REMOVAL: Garbage and recycling procedures will be followed as outlined in directions posted in the property. Garbage is to be placed in the plastic bags provided by the Homeowner. No garbage is to be left in the house when the Guest departs at the end of the rental period.

 


CHECK IN/ CHECK OUT: Check in time is 4pm. Check out time is 9am. The Guest agrees to be charged $50 for EACH hour that the premises are occupied after the agreed upon check out time.

 


SUBLETTING: Guest agrees that this rental Agreement will not be assigned to any other party or the property sublet to any other individual other than the renter noted on this document.
 


FAILURE OF NON-ESSENTIAL ITEMS: There will be no refund of any kind due to failure of non-essential items. Equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Agent will correct the problems as soon as humanly possible. An authorized employee or repairman may enter the premises to repair such equipment. Refunds will not be issued due to malfunctioning equipment/

 


FAILURE OF ESSENTIAL ITEMS: In the event of an unlikely but unforeseen situation at the house in advance of the stay (for example, but not limited to: septic malfunction, pump malfunction, etc), the owners have a right to cancel contract and will, of course, refund rent and security deposit paid in it’s entirety . Owners will make attempts to arrange for alternate accommodations elsewhere if possible. However, owners will not be held liable for any losses or expenses.

 


HURRICANE/TROPICAL STORMS/INCLEMENT WEATHER The Guest agrees to hold the Homeowner harmless on account of any natural disaster affecting the leasehold premises. If a catastrophe (hurricane, tornado, earthquake, flood, etc.) impairs the rental, the Homeowner is not responsible for any of the following:
a. Finding alternate lodging for the Guest.
b. Guest's financial losses related to transportation or alternate lodging If Guests are required by local authorities to evacuate the area, the Homeowner will refund a
pro-rated portion of the unused rent paid by the Guest for the rental, plus any deposit. There are no refunds of any kind for any inclement weather (ie. stormy, rainy, snowy, cloudy, windy, etc) unless there is an evacuation order.

 


CHILDPROOFING: Because the property has not been childproofed in any way, parents must be completely responsible for the safety of their children at all times.

 


ASSUMPTION OF RISK: Any swimming or other activity (including, but not limited to kayaking, canoeing or other boating) is solely at the risk of the Guest and invitees of guest and will hold the Homeowner harmless for any injury or death that may result. No one should swim alone. Guests will hold the Owners harmless from any and all bodily injury and/or property damage incurred on the property arising out of Renters' negligent acts or omissions.
 


MISSING ITEMS - Renters will be charged for any missing items reasonably attributable to Renters and not returned after notification. The cleaning service performs an inventory/survey of the property after Guests depart and notifies the Owner of any damage or missing items. Owner will notify guests in the event that items were inadvertently taken, and provide guests the opportunity to return the missing items.

 


JOINT AND INDIVIDUAL OBLIGATIONS: If there is more than one p a y i n g Occupant, each one shall be individually and completely responsible for the performance of all obligations under this Agreement, jointly and individually with every other Occupant.
MEDIATION: Occupant agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

 


LIABILITY
1. Owner Insurance: Occupant's or guests' personal property, including vehicles, are not insured by Owner against loss or damage due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause. Owner does not insure against personal injury to Occupant or guests due to any reason other than the condition of the Premises.


2. Occupant Insurance: Owner recommends that GUEST carry or obtains insurance to protect guests and their personal property from any loss or damage. 3. Indemnity and Hold Harmless: GUEST agrees to indemnify, defend and hold
harmless Owner and Owner's Representative from all claims, disputes, litigation, judgments, costs and attorney fees resulting from loss, damage or injury to GUEST or GUEST’S guests or their personal property. The Homeowner shall not be liable to Guest, or any other person for any death, injury, loss, or damage to any person or property on or about the premises. Guest shall hold Homeowner, harmless and indemnified from and against all loss or damage occasioned by the use or misuse or abuse of any part of or fixture on the premises and from or against any omission, neglect, or default of Guest, his guest, licensees or invitees.


Release of Liability
•    I understand that I am responsible for all damage, breakage and/or loss to the premises including household contents, furnishings, or equipment not caused by normal wear and tear or unavoidable casualties (deemed by the Agent/Owner) which may result from occupancy. •    Neither Agent nor the Owner will be held liable for any injury, loss or damage that may occur to Guest or their invitees, during occupancy in or on the property.
